It's my observation.....
Ever since the CO claim construction hearing debacle, and the collateral estoppell applied, EDIG has had to settle for pennies instead of dollars just to keep the doors open. HANDAL HAD NO LEVERAGE FOR LARGER SETTLEMENTS. Handal and team did a great job of getting what they got considering the circumstances. If things had gone differently in CO, we would be in MUCH BETTER financial shape now... Shareprice included... BUT... that was not the case...sigh
NOW, with '108 free from collateral estoppel and going into claim construction hearing, the initial court construction looks promising... so with that, it looks very promising for our future.
If things go e.Digital's way, WE WILL HAVE A MUCH BETTER OPPORTUNITY FOR BIGGER SETTLEMENTS = MUCH STRONGER LEVERAGE for HANDAL & TEAM = LARGER SETTLEMENTS IN THE FUTURE. We may even sell something...LOL
So, in a way, it's like turning back the clock and having a do over with 108 instead of 774. 774 was a sacrificial lamb and got roasted. Of course, this is all in MY OPINION.
In my opinion, we are damn lucky to still be in business, thanks FRED, but that doesn't let you off the hook for our future, we need new technology, and we need to be able to sell it. Maybe if 108 claim construction goes our way, e.Digital will get the reputation that NO MATTER WHAT.... if you steal it, we will litigate... So, it will be better for you to license it UP FRONT and MUCH CHEAPER TOO.
I think its all about LEVERAGE... when you got it.. it shows... when you don't, you suffer. I expect a flurry of new cases to be filed after claim construction... if things go well for us.
