You are living in the past...The Markman ruling is not the holy grail here....

Contested Prior art is....

"Patents Pending" takes on a whole new meaning in the big scheme of things.

Let me put it this way...I'm not interested in the company unless the patents are iron clad. And I would most diffidently state, that you would not be interested either.

If they promote, as you consider, and things go a little off kilter with the Markman language that can be smoothed over as a debatable issue in going to a trial.....

However, a dis-favorable IPR of patent-abilty based on prior art ....that is a very definitive issue....and I'll be gone as will you and everyone else if that happens.

You, and others, need to bring this IPR issue into focus. It can be the end or the beginning. I do not care about promotion while this issue lingers.
