Fed. Circ. Calls USPTO Reasoning 'Fallacious' In Patent Case

Law360, New York (June 29, 2016, 5:42 PM ET) -- The Federal Circuit revived claims in a television mount patent Wednesday, while taking an opportunity to knock the U.S. Patent and Trademark Office for the “fallacious” reasoning in one of its arguments defending a Patent Trial and Appeal Board decision.

The appeals court’s ruling is a win for LF Centennial Ltd., which appealed after various claims in its patent were rejected during a re-examination. The patent covers a kit with different pieces for mounting a television with a shelving console.
