"In January 2014, Google and Nest Labs announced that the technology giant would buy the thermostat maker for $3.2 billion in cash, in a deal that gave Google a burgeoning business dedicated to reinventing and modernizing products such as thermostats and smoke alarms. I would love to see a settlement for Billions in cash! "

STIPULATION of Dismissal by Allure Energy, Inc.. (Reichman, Courtland)
==============================
Is this a JOINT consideration?

Ordered on Allure Energy, Inc motion:
** NOT FOR PRINTED PUBLICATION **
IN THE UNITED STATES DISTRICT COURT
FOR THE EASTERN DISTRICT OF TEXAS
LUFKIN DIVISION
JUDGE RON CLARKCIVIL ACTION No. 9-13-CV-102
ALLURE ENERGY, INC., Plaintiff,
v.
NEST LABS, INC., et al., Defendants.
ORDER GRANTING STIPULATION OF DISMISSAL
Before the court is the parties’ joint Stipulation of Dismissal. Doc. # 298.
Per the court...why, yes it is...
The parties seek a dismissal with prejudice of Plaintiff’s claims against Defendants and a dismissal of Defendants’ claims, defenses, and counterclaims without prejudice.
The court is of the opinion that it should grant this motion.
IT IS THEREFORE ORDERED that the Stipulation ofDismissal (Doc. # 298) is GRANTED, this case is DISMISSED WITH PREJUDICE as to Plaintiff’s claims and DISMISSED WITHOUT PREJUDICE as to Defendants’ claims, defenses and counterclaims.
The costs will be borne by the party incurring the same.
IT IS FURTHER ORDERED that all pending motions in this matter be DENIED as moot.
I'll leave it to others to review the now moot motions and thier content considerations.
So ORDERED and SIGNED this 16 day of July,2015

"and a dismissal of Defendants’ claims, defenses, and counterclaims without prejudice."
Seeing that Plaintiff agreed to "with prejudice of Plaintiff’s claims against Defendants "
This is one issue to follow,,,seeing that e.Digitals motion of stipulation was very similar and non revealing as to being mutual.
What ever....time will tell if the Google consideration to "buy the thermostat maker for $3.2 billion in cash" is real.
