The judge really has no say, other than Maybe mysterious issues  of assets being hidden.. if the issue is really brought to her attention.  Other than that, she has to make some kind of a declaration at the end of the whole deal. What is she  going to consider ...." you can't claim bankruptcy, because you have no indebtedness and you have a big carry forward which carries great value"... no the judge ain't going to pay no never mind about it.

What it comes down to is somebody,  knowing of the inside value, coming in and scooping up this company for nothing!!

Someone  could have a product that they have marketed successfully and come in and use this shell against their profits of their product.... it could be any company that we've sued.
