I think it was a possible scneario a few months ago, before September sometime in the summer. However, as each day goes by the liklihood of that scneario diminishes. When that was speculated, they didn't NR how much of the BFS they've done, now they have (all of it save one section). I'd be curious as to who actually think that it's an outcome given what we know now compared to then (which perhaps isn't all that much more). If that did happen, I do think we would have a case for a lawsuit - however I don't seriously entertain the idea just because I think it's such a miniscule possibility.

We do agree that CUU needs to do something ASAP. And preferablly that something is showing us that we've been right to stick with them for so long.
