Lots of variables. Like you mentioned, depth, volume, acreage etc.
From what I've read, the most important is the volume and productivity of each of the tracts. The amount of money each party is willing to spend, and how much they have spent in the past, is also taken into consideration.

No, it isn't. But that would be outside of the scope of the act. After all, it also doesn't explain the concept of exploration either. Unitization is a common procedure all over the world, with many articles written on the subject. I understand what you're getting at though. If the parties can't come to an agreement amongst themselves and the government steps in, they can probably come up with their own participation formulas. From what I've been reading, that is why there is such a big incentive for the parties to come to an agreement on their own.
