I thought that email was ridiculous too. The average investor will not have access to the information that could provide evidence of fraud. It is the job of the regulatory agencies to monitor trading activity, including short sales, and be on alert for collusion among the players. The token level of oversight that has passed as regulatory enforcement is part of the reason there is a problem.
I have a dog at home, and my dog figured out very quickly that the rule of staying off my couch did not matter if I did not enforce it. Now my dog sleeps on the couch all day and I dont even bother trying anymore. If my dog can figure it out, then hedge funds and institutions are going to get the same message, when they can break the rules and only minor fines are the result, if any consequences are imposed at all.
