There's every reason to assume the J's are infringing the '584 otherwise ARM would not have joined suit.
The MMP Portfolio licence includes the '584, so any settlement by the J's would have that incorporated. ARM say to the J's we don't believe that we are infringing the '584 and if you licence the portfolio, you lose any indemnity that might have existed on the '584. Now can you see the potential problem for the J's, even if they wanted to settle?
The current case is for infringement of 2 of the possible 7 patents.
