I cannot see opening the door to individualizing negotiations in regards to the 584 and I could see the J's trying to do just that (within the framework of an overall agreement). Is it really possible to negotiate with the 584 in limbo and come back later to say, by the way, you now owe us for this?

I am curious as to the time frame of the appeal in relation to the time frame of the trial and what that might do going forward mainly from the standpoint that every defense rendered moot is one step closer to an agreement.
