I agree, BUT if I were in their possition I wouldn't assume that they were not going to pull some sneaky stuff, feign like they want to settle and then hope to catch us with our pants down by going to trial with what they hope is an unprepared opponent. 

I like the upward movement today.  Could be a bit higher and I'd feel a lot better.  Also could have more conviction in the volumn and that would help me feel better too. :)
