You may be right. I would agree that looking back now it seems like Swartz had Pohl in his hip pocket. But Pohl did show an umbrella which RG seems to be attempting to act on. Pohl did tell us that TPL would have the responsibility of licensing the MMP. TPL said early movers would get discounts which they did. Yes, Pohl may have been too optimistic about the MMP early and things he said concerning Swartz selling protected Swartz. They said hunreds of companies have been put on notice and that TPL is in communication with these companes. We know that this is still true as of the shareholder meeting this year. But do you honestly believe that Pohl knew at that time how difficult it was going to be to get infringing companies to license with the USPTO re-examination looming. So I ask you do you think your father was misled or do you think he misjudged the timetable and the complexity of the situation?
