Another note: An order to stay the proceedings until 9-18-2009 (90 days) has been granted by the california court. Unless the USPTO has been ordered to expidate the reexam process (I don't even know if that can be done?) then things are looking pretty good for our side. Seems the plaintiff have backed themselves into a corner and may have to talk settlement. One possible bad note: I am not sure if we will be able to license while the stay is in effect ? Looking at part of TPL's argument against the stay they mentioned that they would be financially harmed since their revenue depended on licensing activity. My reservations steem from that statement.
