Actually... have we yet secured a Markman ruling from the ITC? In the ETex litigation in which we were going to determine infringment we had a successful Markman... that litigation was going to push us over the top... oops.. settlement.. Need to secure patent validity.. done, great. In NoCal we have a successful Markman and rexamined valid patents.. that was going to determine infringment and push us over the top... Ok now the ITC... waiting for a Markman ruling I believe.. So.. We have basically 'been here before'.. it's that it's just 5 yrs later.. yeah, we should be farther along.. yeah the ITC could be the culminating step we've been waiting for for 5-7 yrs now... bout time... let's get its Markman hashed out...
