I certainly understand the frustration in your post. The lenthy timeline for a trial can truly be longer than 2 years, depending on the strategy used by the defense. Some patent trials go much longer than two years.

The Eastern District of TX is a bit better at getting the parties together and "pushing" the motions along, according to the attorney we hired from Houston (LL -- it was Fulbright & Jaworski).

The 18 months to 2 year timelines given are for trials, not settlement deals. Obviously, a settlement can be much sooner, but it still takes a lot of time and resources to convince the other guy to settle and then the proverbial "How much $" is in play. Nothing will be done quickly, as in "a few months" unless everyone involved wants it done. It doesn't look like Vivitar is going to go quietly into that good night.

The good news in all of this is EDIG's eVU business is growing. Not to beat that dead horse any longer than necessay, but EDIG needs to sell stuff and leave the IP license deals to the pros.

A little black ink will go a long, long way, IMO. That's the benchmark for me. Not IP deals, nothing but a positive cash position due to selling stuff I can touch. That would make the wait a lot more tolerable.
