The considerations of the parties are too many and complicated for us to asses the outcome of these negotiations. The strategy of both parties should be (are) based on their cost -benefit calculus. In particular, if DM asks too much. for example, several hundred millions, then it may be Sams worth while to take the case all the way to Markman and take its chances with the judge. If Sam offers too little, for example several tens of millions, then it might be DMs worth while to take the Markman route and take its chances with the judge. Since they both agreed to negotiate, it means that the amount is somewhere in between. But none of us knows what is large and what is small for the parties.at this time and with the knowledge we currently have about the negotiations it is impossible to bracket the amounts involved. Moreover, the inteests of DM do not coinside all the way with interests of Edig. My guess is in the upper two number but close to three numbers mil but no more.
