They are attacking the "sole memory" issue as identified in the patent, and are trying to have it identified and twisted as not having RAM present.
If the court rules in their favor on this issue as to "sole memory" meaning no RAM is required or present as you put it....they then will come back with "we therefore are not infringing, because we(defendants) have RAM present in our methods.
e.Digital has RAM present in its methods, it's just not to the scale, type, or utilization as status quo.
