Technically, you are right that the Markman Hearing Judge does not decide the question of "Liability", but as you point out after a Positive Markman Ruling the only question left for a Jury to decide is how much they owe plaintiff, and if the ruling goes for defendats the plaintiff has to expect great many Motions for Summary Judgement...
