Of course getting a Markman Ruling is a defining moment in the history of EDIG. However, other factors are to be considered in refusing a Global settlement package for the group of 16 still holding the bag...

DM are experts at such evaluations, and they will make the proper decision when time comes.

Considering the magnitutde of the project DM has undertaken, (174+, and an ever expanding list of infringers), AND THE FACT THEY HAVE TO ADVANCE ALL THE COSTS of litigation, I doubt they will refuse a "Global Settllement" offer of $60-$80 Million dollars at this stage.

$40 Million dollars or so, will cover a lot of expenses for stage III and beyond for DM.

To put it another way, DM has taken on a project like building a HOOVER DAM, and is funding it as they go along. He is not here to get a positive Markman Ruling and then start collecting the toll from the long list os infringers. If that was the case, they would have done it with the POSTER CHILD SAMSUNG...

It seems to me that DM believes in EDIG Tech. as much as we do. He is not worried that someone will build a better mouse trap...
