"Can a judge make an assumptive decision?"
Can anyone point to "A Matter of law" in the splitting of (if you want to callit that) the claim?
???
She turned all my digital hopes by splitting the claim term identifying memory into two parts....
"Accordingly, the Court concludes that the proper construction of the phrase “a flash memory module which operates as sole memory of the received processed sound electrical signals” is best addressed in two parts."
That is not the complete context of the origional phrase to be considered....the origional phrase is:
“a flash memory module which operates as sole memory of the received
processed sound electrical signals and is capable of retaining recorded digital
information for storage in nonvolatile form”
She did not address the digital issue that is part of the origional patent claim...She ignorred it as to not being important.
She is destroying the patent...that is clearly published as a digital patent.
