The only thing that I would somewhat disagree with you is "How is it that JMK and her clerks have more technical expertise than collectively 13 companies?" Those 13 companies are in a position to make a financial decision as opposed to a pure technical decision. I do not believe that their settling means that they KNOW that our patents are air tight, but more that they feel that the amount of money that the settlememts have amounted to up to this point are worth paying versus taking the risk of the judge finding against them. Certainly the 13 companies have much more technical expertise than the judge and her clerks and they must believe that we are at the very least dealing with grey areas or they would not have agreed to pay anything at all. All of this is not to say that I believe that the judge got it right!
