Doni, your thoughts are well taken. Your modesty notwithstanding, I really want to encourage you to communicate them to Fred or even better to DM. Thinking all by yourself may very well lead to errors you cannot correct. DM has its own advisors but their arguments did not cut it with this judge.They need to jump to a new set of arguments and yours did not appear in their briefs. Do a favor to yourself and to all of us and give them to them. Really, we lose nothing at this point but we could gain a great deal. After all, they can always reject them.
