I agree 100%. This should get us a brand new Markman hearing due to the successful re-examination of the '774. Especially since the diagrams submitted to the PTO during the re-exam clearly show RAM and contradict Judge Krieger's ruling. Of course in her defense, she didn't have the PTO re-exam results available when she ruled.

The Court has to deny APPLE's motion for Collateral Estoppel under these circumstances IMO. Too bad my opinion means squat to the judge though. LOL
