This is an informative email from Richard. Remember the binding agreement stated 3 stages.

1. Sign A&F Agreement. After signing the agreement CRRC/Crystallex would immediately pursue MOC transfer and permit and Crystallex would do #2:).

2. Hold shareholder vote.

3. Closing (permit in hand and MOC transfer).

The quarterly filing did not include the change that the A&F was not going to be signed until Venezuelan Authorities produced acceptable documentation for permit issuance and MOC transfer. At the very least the change was not clearly stated.

I know it has been discussed here and there but I believe this is the first time I have read directly from rm that signing of the A&F will not occur until permit/moc docs are executed in some form. Even now, his statement is not as direct as it could be but what can we expect? He implied this is the case.

This comes in the midst of Roy's and VZ press barrage of "nationalization" of LC. We all know this cannot be done. The government owns the resource already and we only have a contract to mine it.

I suppose the somewhat successful attempt at crushing shareholder spirit and plant fresh seeds of doubt is to force either trading opportunities or send a message to the negotiating table. I have to dismiss the negotiating piece, because Venezuela is currently being courted to invest more $$billions$$ into the aluminum business that has been decimated over the last few years, plus all other areas of investment, not to mention the $16billion not yet released. Nothing wrong with VZ asking for something more but VZ would not negotiate in the public with the Chinese.

It seems folks here have forgotten Chavez Oct. 10th Alo Presidente

(from AVN)

The President of the Republic, Hugo Chávez Frías, said on Sunday that a committee of experts in various areas of mining, from the People's Republic of China, is in Venezuela to provide technical support in the design of various aluminum and gold projects................

Venezuela has about 30,000 billion in proven gold reserves and important deposits of coltan and other strategic minerals for the development of the country, and China provided technology support for the exploitation of these resources.

"Venezuela has become a major strategic ally of the PRC," he said.

I would think we have a high likelyhood of formal news in the immediate future since this shaking was started. When I add everything up, I will wait for the end of the movie.

"""""""""""Hello Mr. McMillan, thank you for the link to the article. The Company follows Venezuelan Government actions and face to face meetings more than the press coverage.

Yes I did speak with Bob last week. He continues to advise me that CREC/CRRC remains eager to complete the transaction and that recent meetings with Venezuela regarding the Las Cristinas Project, permitting and development under the Crystallex MOC were encouraging.

Ultimately the success of the transaction, permitting and advancement of Las Cristinas now remains in the Venezuelans hands and we and CREC/CRRC are doing what we can to speed up their actions.

I have not been advised of any change in targets and still believe that it is Crystallex and CREC/CRRC goal to get everything wrapped up this quarter.

Rgds,

Richard Marshall"""""""""
