Perhaps I can add some perspective.
Our team IMO agreed to the NDA because THAT is what it took to get the deal done. And, IMO, the Js paid a premium for it.
So why were the Js so insistent on including the Confidentiality Clause? Saying face? That was part of it, IMO. But IMO it was more about "saving job/career".
If you were the decision maker for one of the J3, and watched two others of your original tag team settle, plus part of another one, and still stubbornly stood your ground, and ultimately ended up paying some outrageous amount for a license you coulda/woulda/shoulda got for a fraction of that amount, how good of a decison maker are you?
These guys are human, and self-preservation is way up there on the priority list. Hide the facts, bury them in the financials, stay golden.
IMO, there's your explanation.
