I hear you and I respect your views. What you present may be entirely possible. However we must agree to disagree on some points.
The fact remains that all members of the T3 met with TPL to discuss licensing terms. I quote from the ADR submitted by ASUSTEK, "ASUSTEK has met with Alliacense to discuss a possible license'. The ADR's for HTC and ACER contain similar phrases where it is stated that a license was possible. Would they have met to discuss a possible license if they really thought they didn't infringe? While I admit that this may not be adequate to prove that the T3 in fact do infringe one or all of the patents in the MMP, it does in my opinion prove that the reason they are heading to court is because they have been asked to pay a lot of money and not because they think they don't infringe. With approved patents (and there is the possibility that at least three of the 4 patents could be approved soon) would they risk going to court and paying a much higher fee ? My rose colored glasses say no.
RG is doing what the previous two CEO's should have done to sustain the share price, hope for the best and plan for the worst.
Your last point about a sustained share price is valid. However if the patents are approved and RG follows through with a merger prior to the approval or soon after I see no reason for PTSC being unable to maintain a much higher share price.
