<My only concern is point out that just getting reexams finished in our favor does not open the floodgates for settlements esp. if the accused infringer is willing to slug it out...we can hope with reexams in our hands they will see the fruitlessness of their actions and settle, but that's not always the case and we should be prepared for what could be a longer than expected time period for higher license fees to materialize>
I do believe there is another side of the coin. Up to this point TPL/PTSC has not agressively pursued legal action against infringers. Assuming that the T3 in fact infringe on MMP patents, and should we start to see PTO approvals, it might be a very high risk gamble for the T3 to go the normal distance. The longer it plays out, the higher the risk that there could be more at stake than just the money. That being demands for public disclosure. TPL/PTSC may use the opportunity to get some respect after the J2.5 settlement. Something for the T3 to consider. IMHO Opty
