It's due within 3 months of the filing date of the request, which was 4/24/09. I presume if the determination is made to reject the request, then that would indicate that a decision on the re-certification or rejection on the '336 will also have been made, thus obviating the need for another re-exam.
If the re-exam is ordered, then I suppose that might explain Lecky wanting out, even if it means a small payback now, versus having to wait it out again for a possible big payback in another couple of years. Who knows.
Hopefully we'll see a decision by the examiner to deny the re-exam, and an entry in the transaction history shortly thereafter of the "notice of intent to issue a reexam certificate". That would mark the start of an approximately 90 day period until it would become official, likely best case being sometime in November.
