Success could mean many things to different people.
If there are settlements before it ever gets to a jury, could we still have success? If the settlements are not made public (no matter the amount), could we still have success? Assuming we can somehow roughly derive how much was paid and or owed, what is a successful amount from each of the litigants?
Keep in mind that we do not know which products infringe and the extent of past/future infringement on each patent. Nor do we know for sure the impact of ongoing USPTO reexams and amendments to completed reexams. And we do not know the license fee that was originally put on the table before litigation. And is sucess for PTSC and success for TPL aligned sufficiently?
Just wondering what the preconceived notion of success is and whether the general population could agree on anything. Perhaps a good topic for discussion?
