I think my strategy would have been to go after smaller companies that infringe industry wide designed chips because they would not have had the resources to fight as fiercely as the larger companies. Once I had established infringement I would have gone after the larger companies with the threats of injunctions and willful infringement. I guess there is a reason to do it the way TPL has done it, but I don't know what it is.
