That is correct. The reason that the court determined that gross MMP revs meant total MMP revenue (including PTSC's share), is because TPL was the sole licensing agent. Brown is due 3.5% on the total license revenue as long as TPL remained the sole licensor on the docs. The Js settlement was one of the exceptions since PTSC is also listed as licensing agent.
But PTSC was not a party to the Brown litigation, hence we are not responsible for payment of what is due to Mr Brown.
