Secondly from your report:

There will be no license "payments". to EDig. All lawsuits, if won, will include a one time payment from the offender and EDig will issue a license, to use forever.

1- Would EDIG try to gain revenue from design fees since there would be no reoccuring revenue from the above scenario?

2- Is MOS an evolutionary technology which will change therefore creating the need to licence  an newer version?
