I’m not sure I agree. EDIG/DM filed infringement against Samsung for 4 patents, then agree to dismiss 2 of those patents. I don’t see how reducing our patent infringement claims by half couldn’t affect the number of products Samsung has allegedly infringed on and consequently, any settlement or jury award we would expect to receive. Perhaps as Sinkman has said, EDIG shouldn’t have included the 445 and 108 patents in the lawsuit since they either aren’t in play at all or are only minimally. Or perhaps DM is so brilliant and knew the 445 and 108 patents were only minimally in play that they anticipated Samsung would object to them and planned all along to agree to dismiss them in the pseudo-spirit of cooperation and collaboration.

My first take on this news was Samsung and EDIG are indeed cooperating in an effort to settle. Why on Earth would EDIG agree to dismiss 2 of their patents without putting up a fight unless it’s a strategic move toward a satisfactory goal? I agree with lovelygrl and trillium it has streamlined the case but believe it can affect our monetization to some degree.

I knew I should have gone to law school. I guess I’ll have to settle for staying at a Holiday Inn Express this weekend...preferably one that’s being used during a lawyers convention.
