Our current thoughts are with regard to stipulation 1....and the underline phrase.

"1. All claims by e.Digital Corporation of infringement relating to U.S. Patent Nos. 5,787,445 (“the ‘445 patent”) and 5,839,108 (“the ‘108 patent”) that have been or could have been brought in this lawsuit against Samsung Electronics America, Inc., or related Samsung entities that could have been named in this lawsuit, are hereby dismissed with prejudice."

Our current thoughts are the phrase or could have been brought would seem to suggest that e.Digital would not be able to introduce any claims involving 445 or 108 against Samsung in any future actions.

If that be the case, it brings up yet another concern dealing with "or related Samsung entities". If Samsung now decided to buy a company from within the industry, would that entity be protected under this stipulation?

Now place Sandisk as the entity....
