I suspect there were ongoing negotiation with note holders with note holders offer most likely were lowball buyout say $0.35 on the dollar "opinion only, pure speculation off CJR call on timing of note holders lawsuit", thinking lawsuit may be a part of counter negotiation on the note holders part, think since most of these notes were brought on the cheap on open market after 2005 Chavez speech on taking over mining sector, these holders should be happy with one interest payment and $50.00 to $55.00 buyout for notes, the last lawsuit was led by a hedge fund that invests mostly in distressed bond, forgot the name, these are smart guys, given the circumstances they could gamble or take what they can get, come to think on it, would in not be in the corporation best interest to make thing look as bad as they can when negotiating a $100 million notes buyout that they clearly can't afford at this point? who the heck knows what's really going on, opinion and speculation is cheap and free and anyone can do, very small percentage of the time we may be correct, mostly not...
