A little more info about the line in one of my previous posts:

"The accounts were in an autobiography first published in 1929 by a well-known American labor organizer, Bill Haywood. One was from a cavalry volunteer who participated in the slaughter and the other by a tribal member who survived it."

Haywood's account was claimed to prove the Plaintiff's version that the 1865 attack on Native Americans did occur at Thacker Pass.

The author of that quote above did not specify his or her statement about just which organization Bill Haywood was in association.  Instead, the term used was "a well- known American labor organizer".

A little sleuthing on Mr. Haywood turned up some surprising information, espcially surprising since it is his account that has been so crucial in the claim of the Plaintiffs and their attorneys about "New Evidence" in regard to the claimed massacre at Thacker Pass in 1865.  It doesn't mean that Haywood's account is bogus, but shining light on Mr. Haywood turns up some very interesting information in itself.

It didn't mean much to me when I first encountered the quote I posted earlier about Mr. Haywood's account of the incident that reportedly occurred in 1865, but since then I have learned that Bill Haywood, the same Bill Haywood, is described in Wikipedia as:

"William Dudley "Big BillHaywood (February 4, 1869 – May 18, 1928) was a founding member and leader of the Industrial Workers of the World (IWW) and a member of the executive committee of the Socialist Party of America."

Further in the Wikipedia description it states:  "Haywood was often targeted by prosecutors due to his support for violence" and later goes on to state:  "He was sentenced to twenty years. In 1921, while out of prison during an appeal of his conviction, Haywood fled to the Russian SFSR (Russian Soviet Federative Socialist Republic), where he spent the remaining years of his life."

At one time in my life I belonged to an organization that evaluated information based on 2 separate 1 to 10 rating scales.  1 being there was no confidence in the person or the information.  10 being that the information or the person was as solid as it could possibly be, a "fact".

So, how might that apply to Mr. Haywood's account of the incident he claimed occurred in 1865 at Thacker Pass?  Well, that is for each person to decide on their own. 

My personal opinion, and it is only an opinion, as influenced by now knowing more about Mr. Haywood is that I would evaluate the "information" Mr. Haywood gave about the September, 1865 event at Thacker Pass as a 5 or 6, 7 tops.  I would evaluate the source, Mr. Haywood, as a 1 to 2 out of 10, 2 being tops.

Taking the best average of the two scores the best I could come up with, in my own opinon, would be  in the range of 3 on the low end to 4 1/2 on the high end.  Not exactly a resounding score to evaluate the "Veracity Factor" of the account given by Mr. Haywood, but after all, that is just my own opinion, nothing more.

The IWW and Mr. Haywood, both, have a very colorful history to say the least and he was not just any ordinary American labor leader and the IWW was not just your average labor organization.  So strange how such a nefarious character could be so crucial to the argument of the Plaintiffs and of their attorneys.

So where was "Big Bill" when he published his 1929 account of the events he said occurred back in 1865?  In 1929, "Big Bill" was at home.... in the U.S.... excuse me.... I mean he was at home in Russia where and when he published his "autobiography".  Not much chance of "Fact Checking" him back then, no doubt.

I would be willing to bet that Plaintiff's attorneys wasted no ink,when they submitted their "New Evidence" "proving" the Thacker Pass Massacre occurred according to their claim, by adding full disclosure about the source of that "New Evidence". 

It goes without saying they didn't do a 1-10 analysis on a 2 factor scale for the information vs the source of that information, much less submit the results of that analysis to Judge Du.
