No, I am not going to say I find a flaw in your logic. I don't necessarily agree with how you look at things, but it is purely semantics and a difference in point of view. I don't consider a gain in share price to be considered profit until it is realized meaning I have sold my shares and am paying capital gains. Anyways, difference in view, not worth the conversation.
But again, my main question, and the one that has me concerned the most, is if Swartz is selling, than why? I hope he is not, and that the resistance we have seen is flippers who bought at .44 and realized almost a 50% gain in less than a week. If Swartz is selling, especially after his comments at the last SHM, where he stated a positive outcome in Texas would be the difference between a 15 cents/share stock and a $1.50, $3.00, or even $4.00 share stock, than I can't understand why he would be selling today when it appears a settlement is right around the corner. Let's hope there is a settlement and it is for big $$$. I am betting my profit on it!
Good luck to you, me, us, and all longs.
