It is preferable that claim 29 overcome the adverse markman. The alternative is a worthless patent with no ability to sue for past or future infringement. It was more than just ARM that was let off the hook when the appeal failed. I suspect you are correct in that Barco may not have enough 584 infringement to make it worth the effort.
