That is your perspective, that DM did not utilize a brilliant strategy, or even a mediocre strategy, they just mistakely made unusually broad claims, that were smacked down by Sammy lawyers.
It is just wrong to bring an interpretation so narrow that it serves to project the notion that DM is stumbling about and completely ineffective.
