Not at all, not from my prospective. It is clear, the court could care less about e.Digital and its pleadings, ...regarding the phrase ""flash memory module which operates as sole memory of the received processed sound electrical signals"
Which is not the complete Claim term phrase published in the patent:...
"a flash memory module which operates as sole memory of the received processed sound electrical signals and is capable of retaining recorded digital information for storage in nonvolatile form"
The first judge did not rule completely either...
In any event, the phrase takes on a whole new meaning, ... without having been itself modified in any way, ... due to other issues that did modify in the re-exam process.
The judge is considering that the phrase did not change, as it still reads the same , with that, nothing has changed. That is the basis of his findings including the authorities he sited.
Handal went to great length to make that consideration known, it does change in meaning and the judge flat out does not want or see truth prevail. Even to the point that he did not even consider the alternative of postponing the ruling until after a claims construction proceeding.
IMO, there's not much more that could have been done on Handals part....with that, for all those that hold some form of animosity against management....get a life...management did all it could do under the circumstances.
