Paying EDIG millions without first going to court and also dragging out the litigation every way they can wouldn't be favorable to them. Apple has no problem spending millions in legal fees just to prove they are not to be messed with by patent trolls... which is what we are to them.

Whatever settlement was reached is likely to be very small (a "walk-away" settlement) in the absense of some other factor or agreement that the company has yet to disclose. Another small settlement would represent the status quo and it's on that basis that I must interpret this as bad news.

I get why Apple had no reason to settle unless the settlement agreement was favorable to their position or objectives. They have the time, resources and motivation to drag this out for as long as possible.

From EDIG's perspective I don't get is why we settled so quickly ( would be weak and bad practice given future law suits) and have now concluded one of two things must have happened.

  • We either quickly determined we didn't have much of a case ( after decades of waiting to file an infringement actions against Apple?) and took what we little we could ( which seems out of character for the impressive Handal and Associates)
  • Or, we were offered very strong business reason to settle.

Lot's of logical and well though out posts to the contrary today but I'm still leaning we had ample motivation and reasons to just settle.
