If they've made use of their time, they have put together a series of contingencies based on assumed levels of Cash and revenue based on how well they fare at trial.

If they haven't, they haven't done their fundamental job in making best use of existing capital (I.E. in earning their current paychecks) and in creating a timely business plan in moving forward.
