I think if we lose at the ITC we will not be going to the CAFC as by the time a decision would be reversed the patent would have expired and there is no such thing as retroactive import barriers. We have 1.5 years until the 336 expires and an appeal at the CAFC would take about the remaining time once the ITC renders its final determination. Then we have to go after everyone in federal court which would take a while. Obviously negotiating the legal cost of litigating to conclusion IMO would be the best course of action if we lose at the ITC.
