Bingo. You hit the nail on the head (in my opinion). I think it needs to be a lof of infringers very fast. Maybe take one or two giant corporations to trial if needed, but get many of the smaller ones. I know no one likes the niusance suits, but if it would be possible to blanket many companies with relative smaller damage claims, it may work out better. In that case the NDCA can be used as a hammer, even if the ITC outcome is negative.
The companies would know that they face possible court action and a possible loss if they resist. That may be motivation enough to settle. And again, at least some basis for settlement is now public. Before, making $1B damages claims and then settling for pennies on the dollar was not a helpful approach. Now, the NDCA is a concrete example of what companies may face. Settle for $1M or spend $10M defending a case that was already lost in the NDCA.
