You can tend to believe whatever you want. It is a free country. Lori's post is correct in that the controlling directional relationship from the ITC to the NDoC does not exist. But the opposite is also true where the NDoC is not controlling over the ITC. Both venues can be used as a persuasive authority for each but the current system is broken IMO with respect to these two venues being used for IP litigation. The appelate court controls both, but as I posted earlier the CAFC is essentially out of the picture for the ITC. I'm extremely confident in the above and we can agree to disagree.
