Please see my prior post made a couple hours ago that states by the time we would finish with the CAFC, the 336 would pretty much be expiring. How are we going to get the ITC to ban imports if the patent has expired? It would be pointless to spend a bunch of money on our lawyers (who work on a contingency basis BTW and the CAFC doesn't award damages) to have the ITC overturned because the 336 wouldn't be enforceable at ITC anymore.
