By that I meant that our patents have never been found to be valid and infringed by any particular party. Agree there have been several determinations by the court along the way, just none that should cause much concern from any company considering trial.
There are numerous avenues of defense remaining for anyone unwilling to settle... unless of course, they can simply make the case go away for a relatively small amount.
The issues decided thus far have not exactly been tested so to speak, at least not in any meaningful way where large dollar amounts are at stake.
