That may be the case, we have no idea of what is taking place.
Transmeta and Intel were trying to hammer out a cross licensing agreement prior the law suite.....they could not come to terms.
However, As I have read, perhaps misunderstanding, this prior process could be detrimental to a defendant.
Is it not now fashionable to wait for filing on the part of a defendant?
In other words, Intel basically admitted some form of wrong doing by trying to come to an agreement prior a law suite.
Did that process help or boil away Intels arguement?
They got cold feet in the end, that IMO, others will now avoid.
