Depends on your assertion of early settlement....in the Vivitar scenario, at what point is early settlement?
I see it as May 2010 because I'm running out of time, or, I might wait for the completion of the Markman hearing and settle 1 day before the judges ruling.....lol
There is no penalty to wait....this is an early settlement.
