I don't mean to belabor the point but EDig is NOT interested in "licensing or royalties". If a company is proven to be an infringer and CANNOT pay a settlement then what makes anyone think that company can pay royalties?
Would appear to me if I were EDig/DM I would not be convinced I would get ANYTHING from a company that was cash starved. In fact if it were me I would be convinced the only royalties I would be receiving from that company would be those assets I could get from a Marshall confiscating the CEO's Mercedes in the parking lot.
THINK ABOUT IT.......What does EDig/DM do if the infringer misses a royalty payment 6 months down the road. There are Lawyers/Attoryneys on this board........LL......who can speak with authority on the legal morass and costs associated with going to court to enforce this kind of problem.
Do you think EDig/DM wants to be in a position where they have to anticipate this or would a "one time payment" be preferred and wanted....
